What is RODO?

On 25 May 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) enters into force. What is personal data?

Personal data means information about an identified or identifiable individual. It is about the data obtained from you, when you ask for products, sign up for the newsletter, send us a message via the contact form or place an order or purchase our products electronically or by phone, email.

What is the purpose of processing your data?

1. We process your personal data for the purpose of (basis in Article 6(1)(b) of RODO):
   • conclusion of a sales contract based on your interest in our offer and placing an order,
   • enabling the provision of electronic services,
   • handling requests that you send to us (eg via the contact form or email)
   • contacting you, including for purposes related to the provision of services;
2. We process your data for tax and accounting purposes (based on Article 6(1)(c) of RODO).
3. If you consent to this, we will process your data for the purpose of (based on Article 6(1)(c) of RODO):
   • sending commercial information based on your consent;
   • in order to carry out communication through the system provider to send information mailing and newsletters;
   • handling your requests forwarded in particular to the service department and via the contact form in a situation where they are not directly related to the performance of the contract;
4. We process your personal data for the purposes indicated below, based on the legitimate interest of LIOGAM SP. ZO. O. SP. K. in the order to (basis from art.6 par.1 letter f of RODO):
   • archiving (evidence) to secure information in the event of a legal need to prove facts;
   • possible determination, investigation or defense against claims;
   • customer satisfaction surveys and determining the quality of our service;
   • monitor your activity on our Website;
   • conducting research and analysis, among others in terms of the functionality of our website, improving its operation or estimating the main interests and needs of visitors;
   • debt collection; conducting court, arbitration and mediation proceedings;
   • conducting statistical analyzes;
   • offering you products and services directly, including matching them to your needs with the help of profiling;
   • offering you directly (direct marketing) products and services of companies cooperating with us (our partners), including matching them to your needs with the help of profiling

The processing time of your data depends on the purpose of processing. It usually results from the period prescribed by law, such as the need to store accounting documents, the period of limitation of claims, warranty claims. If you consent to the processing of data for example for the marketing of products and services, your personal data will be processed until they are withdrawn.

Who can we share your data with?

According to the Regulation, we may transfer your data to entities that process them on our behalf, eg subcontractors, suppliers providing IT, accounting, courier, postal services, marketing activities, as well as entities authorized to obtain data on the basis of applicable law e.g. law enforcement agencies, courts - based on a request with the legal basis used.

What are your rights to your data?

You have the right to obtain information regarding the processing of your data and a copy thereof. You also have the right to request the rectification, deletion or limitation of your data processing and the right to transfer the data provided and the right to object to the processing of your personal data.

If something disturbs you, it is possible to submit a complaint to the supervisory body dealing with the protection of personal data.

At any time you can also withdraw your consent to the processing of personal data, if the basis for processing is consent about what you must notify us.

Do you need to provide your personal details?

Providing personal information is voluntary. To the extent that the processing of your data takes place in order to send an inquiry, conclusion and performance of the contract, the failure to do so will result in the inability to do so.

On what legal basis are your data processed?

Data processing is based on applicable law, as well as applicable store regulations. The basic legal basis is the processing of data enabling the conclusion and performance of a sales contract. Your personal data will be processed in an automated way (including in the form of profiling), however, it will not cause any legal effects to you or substantially affect your situation.

Profiling of personal data by LIOGAM SP z o. O Sp. k. is about processing your data (also in an automated way), by using them to evaluate some of your information, in particular to analyze or forecast your personal preferences and interests.

What is automated decision making?

In the risk analysis process, we make decisions in an automated manner based on the data we have about you. Based on this information, we assign you a personal profile that is relevant to the ability to offer you our services or the services of our partners and the amount of discounts that we can give you. These decisions are made automatically based on the risk assessment methods. Decisions taken in this automated way affect the availability of products or services / the selection of products offered to you.

What is profiling?

It means the processing of personal data involving the use of your personal data to assess some of your features, in particular to analyze or forecast aspects relating to your personal preferences, interests, credibility, behavior, location or movement. We profile you for the needs of choosing an offer for your preferences.

Decision-making in an automated manner for the purposes of the abovementioned is necessary for the purpose of concluding or executing the contract that connects us.

Decision-making in an automated way is based on the consent you gave. If you do not agree with our assessment of the situation thus carried out, you can submit a complaint by e-mail to our contact address. Please provide the information that you think justifies the incorrectness of our assessment. You can also be asked for this information later.
